TERMS OF PURCHASE FOR ALL LEARN TO POSE™ PRODUCTS AND SERVICES

This is a binding legal contract. Please read it in full.

Thank you for purchasing a Learn To Pose™ product and/or service! Here’s what you need to know.

Please read these terms carefully as they are a binding legal contract, and we suggest downloading a copy for your records.

Our products and services include, but not limited to: group in-person and virtual posing classes, group in-person and virtual posing clinics, courses, virtual masterclasses, digital products, 1 on in-person and 1 virtual posing lessons, and the Posing Wins Shows™ program.

1. When you purchase a subscription to any of the Weekly Group Virtual Posing Classes the terms of purchase are as follows: Each class is a separate subscription and cross over into other classes is not allowed. You are paying $100 per month for this subscription which provides you the opportunity to attend up to 4 classes within this 30 day period. Classes are not a la carte. When you purchase a subscription you are paying in full for the 30 day experience and there are no refunds for any classes that you miss. Classes are recorded and replays will be available within 24 hours of class completion. Your class purchase includes access to a private Facebook group. Access to all replays are provided for classes in our private facebook group. Replays stay posted for up to one week after the class has concluded. If you are purchasing this in your business capacity you guarantee this purchase as an individual.

In addition please allow 24 hours for a welcome email from me with class access instructions and a link to the private Facebook group.

2.When you purchase a group posing clinic ticket, the cost is $25 per ticket for virtual clinics and $50 for in-person clinics, and your ticket is non-refundable. The ticket you purchased applies to the exact clinic date you purchased. Tickets cannot be applied to future clinics if you are a no-show to the clinic you signed up for. Attendees are not allowed to record any part of the clinics and replays will not be provided. If you are purchasing this in your business capacity you guarantee this purchase as an individual.

3.When you purchase any of our courses, digital assets, or masterclasses your purchase is non-refundable. Prices for all of these products vary and a complete list of all courses available can be found on https://learntopose.podia.com/ If you are purchasing this in your business capacity you guarantee this purchase as an individual.

After payment you will receive a link within 24 hours with login instructions from Podia, where all my course materials and digital products are housed.

4. When you purchase a 1 on 1 posing session, the cost is $100 per 40 minutes for virtual and $150 for in-person per 40 minutes, and purchases are not refundable. If you need to re-schedule your private 1 on 1 a session you will need to do so within 24 hours of the scheduled session. All virtual sessions are held on Zoom. After payment you will receive an email confirmation and an email with the zoom access instructions to your session. If you do not receive your access instructions, please email support@killitwithdrive.com no less than 24 hours prior to your scheduled session. If you are purchasing this in your business capacity you guarantee this purchase as an individual. 1 on 1 virtual posing sessions will be recorded by us and you will receive a link to your recording within 24 hours of your session. Recordings are confidential and you agree to not share or distribute the recording to anyone. Sharing recordings is a violation of United States Copyright law.

5. When you purchase the 8 week membership to the Posing Wins Shows Curriculum this will include: lifetime access to the Mobility For Posing Course, a 1 on 1 Posing Assessment & Road Map call via zoom, 8 weeks of weekly posing critiques, 8 weeks of weekly group posing practice classes, Free attendance at a Learn To Pose Virtual Posing Clinic, and 8 week access to the Posing Practice Insiders group for posing critiques and advice. You are either paying $997 for this program as a one time payment in full or paying $1,050 in two installments of $525 per month for 2 months. If you are purchasing this in your business capacity you guarantee this purchase as an individual.

What happens after you pay:

Our secure payment processor is Stripe. You’ll receive a receipt for your records shortly after purchase and your credit card statement will identify the program/service/product. For example, if you purchase Posing Wins Shows, your statement will say: Posing Wins Shows. *All programs, courses, digital assets, and services have a no refunds policy. Your payment is your acknowledgement of this policy.*

After payment you will receive a link within 24 hours with login instructions from Podia, where all my course materials are housed. In addition please allow 24 hours for a welcome email from me with instructions and a link to the Posing Wins Shows Insiders Facebook Group.

Refunds:

All programs, services, products, and digital assets have a no refunds policy.

Please note: Whether or not you access the program materials, the refund policy applies.

Payment Schedule:

If you are paying in full, you will be charged one time on the date of your purchase.

If you are enrolling in a class membership, your card will be charged on the date of purchase and then again every 30 days until you cancel your subscription. To cancel your subscription, you must email support@killitwithdrive.com no less than 5 days before your subscription renews. Once the payment has been processed, there will be no refunds.

By completing this purchase, you acknowledge, agree, and authorize us to charge your card on a recurring basis every 30 days.

If you are paying for the Posing Wins Shows program in installments, your card will be charged two times:

· Once today for $525;

· Again in thirty days from today for $525

By completing this purchase, you acknowledge, agree, and authorize us to charge your card on a recurring basis on these dates.

Please note if you are paying in installments. This program is an “all or nothing” purchase. If your card account is declined for any reason (insufficient credit, closed, expired, or other reason), we will contact you to update your payment information. You agree to do so within 5 business days. Failure to update your account information will cause your access to the program to be suspended entirely without refund for amounts already paid. This is not a pay by month, or pay for partial access, situation, which would not be fair to those who have committed to the entire payment plan.

License to content: You are receiving one license for personal viewing and implementation of the material in any of our programs, courses, digital products, or masterclasses in your own life. You are in violation of United States copyright laws and contract law if you use the material for any other purpose, including making derivative materials, selling it, sharing it with others who are not program members, training others in the program (in whole or part), displaying it publicly or on the internet, and/or sharing your login credentials. Licenses for these items are available for purchase, starting at $5,000. If you choose to take these actions, you will be notified and billed accordingly.

Acknowledgment: By completing your purchase, you acknowledge and agree that you have read these Terms of Purchase, our Privacy Policy, Terms of Use, and Disclaimers as they may be amended from time to time.

Disclaimer and Limitation of Warranty: You are in the best position to understand your unique circumstances, and you understand and agree that a general informational program such as any of our products cannot be completely tailored to every single person. These programs and services are not a substitute for medical advice from a qualified professional. You are advised to use your best judgment and seek the advice of such professionals in implementing the principles of any of our programs, products, or services. No guarantees are made as to outcome for the use of our programs or services.

Waiver of liability and Governing Law: This contract is governed by the law of the State of Connecticut without regard to its conflicts of laws principles. You agree without reservation to personal jurisdiction in the Connecticut courts in the event of dispute concerning this agreement or your use of this program.

THIS SITE AND PROGRAM, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY SITE-RELATED SERVICE, IS PROVIDED “AS IS,” WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THIS SITE, SITE-RELATED SERVICES, AND HYPERLINKED WEBSITES.

KILL IT WITH DRIVE, LLC, LEARN TO POSE, LLC, ITS AFFILIATES, OWNERS, AND ITS SPONSORS ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES ARISING OUT OF OR RELATING IN ANY WAY TO THE SITE, THE PROGRAM, SITE-RELATED SERVICES, CONTENT, OR INFORMATION CONTAINED WITHIN THE SITE, AND/OR ANY HYPERLINKED WEBSITE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE PROGRAM, SITE, SITE-RELATED SERVICES, AND/OR HYPERLINKED WEBSITES IS TO STOP USING THE SITE AND/OR THOSE SERVICES. Your state may not allow limits on warranties and damages. If so, these do not apply to you. If so, the remainder of this agreement shall be enforced as if the limited warranties and/or damages clauses are not there.

BY CHECKING THE BOX TO THIS AGREEMENT ON THE ORDER FORM YOU ACKNOWLEDGE AND AGREE TO ALL TERMS AND CONDITIONS OF PURCHASE.
